![]() Brigitte Chandler There are five types of asbestos diseases for which claims can be brought:
Limitation
A claim has to be filed at Court within 3 years from the date that you are told that you are suffering from an asbestos illness by your Doctor. If, however, for some reason you are out of time, it is still possible to apply to the Court for leave to bring a claim out of the time period and this will be granted if the employer will not be prejudiced and there is a good reason for the delay.
What happens if the employer no longer exists?
It is possible to restore a Limited Company to the records within 20 years after it has been struck off the record. Obviously, it is only worthwhile doing this if the insurance company is available to pay the compensation. We have considerable experience in looking for insurers for these types of companies.
How much is the claim worth?
Each case has to be considered on its own merits.
Claims vary between £6,000.00 to £500,000.00 in the more serious cases. In addition, the Defendants will pay legal costs on top of this sum. You will need an experienced industrial disease lawyer to evaluate your claim. How do I pay for my legal fees?
We deal with most of these claims on a "no win, no fee" basis. This means that you only pay our costs if you are successful and receive compensation. If this occurs, the Defendant will also usually pay costs on top of the compensation payable.
Will I have to go to Court?
Most cases settle out of Court and there is a reasonable prospect that you will never have to attend a trial to obtain compensation. Sometimes it is necessary to issue proceedings but cases often settle shortly before the Court date.
