| No Court Divorces Now A Reality | |
![]() Peter Berry Peter Berry, an experienced family lawyer and legal executive at solicitors, Charles Lucas & Marshall, is among the first in the country to qualify as a collaborative family lawyer.
Collaborative family law has recently been introduced into the UK in an attempt to allow couples to manage their separation or divorce in a more dignified and less confrontational way.
The process involves couples and their collaborative lawyers working together to resolve issues without going to court. Issues are resolved through structured meetings, with couples setting the agenda and listening to each others wishes and needs.
Their collaborative lawyers act as guides, by providing advice and legal support. Crucially, couples agree from the outset that they will not drag each other through the Courts.
"This is a new concept in how couples can resolve what happens at the end of their relationship,” says Peter Berry. “They are ultimately in control of the process and we are there to provide support, objectivity, legal knowledge and, if necessary, to enlist other experts to help.
“The traditional approach of going to Court first before issues are resolved, tends to polarise attitudes quickly and forces couples to highlight their differences. These problems often result in long lasting difficulties between couples.
“Collaborative Family Law is a culture change in the UK. If issues are settled early on, the costs both emotionally and financially, will be far less.”
