Swindon Lawyer Wins Asbestos Ruling

Swindon lawyer, Brigitte Chandler, has won a court ruling which means a woman whose husband died from exposure to asbestos, can still take legal action even though her claim for compensation was made too late.
Judge Nicholas Marston ruled today (23 Jan) that widow, June Stephens can go ahead with her claim for compensation despite heavy resistance from insurers who said her claim was out of time.
Mrs Stephens’ husband, Jack, died in March 2003 after developing asbestosis. He had worked as a ceiling fixer for Anderson, Firmin & Collins and had worked in numerous department stores and supermarkets, putting up asbestos tiles.
He was first diagnosed with asbestos disease in 1997 but did not take any legal action because he was told the company was in liquidation and believed there would be no money to pay him any damages.
His widow, June, was then told that any personal injury claim had to be brought within three years of diagnosis. However, Brigitte managed to find insurers who were responsible for employer liability claims for Andersons and decided to make an application to the court to bring a claim out of time.
At a court hearing in Swindon on 14 December, Mrs Stephens was represented by Brigitte Chandler of Charles Lucas & Marshall, the insurance companies responsible for liabilities incurred by Anderson, Firmin & Collins argued strenuously that Mrs Stephens claim had been brought too late.
However, Judge Nicholas Marston has decided that Mrs Stephens can pursue her claim and has given permission to Brigitte Chandler to pursue the case.
We are delighted with the decision,” says Brigitte Chandler. “When I met Mrs Stephens I told her that even though the case might be legally out of time it was worth fighting for. It will be a very substantial claim.
Mrs Stephens now lives in Glastonbury, Somerset.
“However we would also welcome any comments, which will be treated with the utmost confidence, from anyone who worked with Mr Seabrook or has detailed knowledge of the use of asbestos in the car park.”
