Mesothelioma is caused by repeated exposure to asbestos. The inhalation of asbestos fibres causes this, relatively uncommon, form of cancer affects the Pleura which surrounds the lungs, the lining of the abdominal cavity or Peritoneum and the surrounding tissue of the heart. The asbestos fibres attack the lungs over a number of years with chronic affects not setting in until at least ten years. There is no cure and it can be fatal if not treated with suppressants. The mesothelioma case can be tricky as many companies who are at fault for exposing their workers to asbestos no longer are in operation.
A mesothelioma case claim has to be filed at Court within three years from the date that you are told that you are suffering from an asbestos illness by your Doctor. If, however, for some reason you are out of time, it is still possible to apply to the Court for leave to bring a claim out of the time period and this will be granted if the employer will not be prejudiced and there is a good reason for the delay.
Most mesothelioma cases settle out of Court and there is a reasonable prospect that you will never have to attend a trial to obtain compensation. Sometimes it is necessary to issue proceedings but cases often settle shortly before the Court date.
