The Department of Work and Pensions (DWP) has set out a consultation paper to create an Employers' Liability Tracing Office - to help people injured at work track down their employers' liability insurance policies.
"This is long overdue as far too many people suffering from serious industrial diseases are unable to trace employers' insurance policies and get the compensation they deserve," says Brigitte Chandler, a partner with Swindon law firm, Charles Lucas & Marshall and a specialist in industrial disease litigation.
The Government is also proposing a fund of last resort for workers unable to trace their employers' insurance policy.
The proposed tracing office will incorporate an electronic database of employers' liability insurance policies, making it easier to track down records.
When a person in injured or made ill through their work as a result of their employers' negligence, they would normally claim civil damages from their employer. However, large numbers have been unable to trace their employers' insurance policy.
"This is because some industrial diseases only appear decades later," explains Brigitte Chandler. "This announcement will be particularly useful for many of my clients who develop asbestos related disease, perhaps up to 60 years later.
"By this time, many employers have ceased trading or have lost their insurance records."
A voluntary Code of Practice for tracing employers' liability insurance policies, set up in 1999, has led to some improvements but many workers have still been left without help.
